Stamp duty and registration charges in Gujarat 2026

What this guide covers

Buying a flat or plot in Gujarat? You pay 4.9% stamp duty and a 1% registration fee, both on your deal price or Jantri value, whichever is higher. On a ₹50 lakh flat that is ₹2,45,000 stamp duty and ₹50,000 registration fee, ₹2,95,000 in all. Keep this money ready on top of your down payment, because banks usually don’t lend for it. If the property is registered only in a woman’s name, there is no registration fee, which saves ₹50,000 on a ₹50 lakh flat.

You will often hear people say stamp duty in Gujarat is 4.9%. That figure is the 3.5% basic duty plus a 40% surcharge on it, which comes to 1.4%. You pay both together.

These rates apply to the sale of a flat, house, plot, shop or office. Gift deeds, rent agreements, mortgages and power of attorney have their own separate rates.

How to calculate your stamp duty

You can calculate it yourself in five steps.

  1. Find Jantri rate for your property’s zone. Our guide on how to check Jantri rate online shows you how.
  2. Multiply Jantri rate by the area of your property. This gives you Jantri value.
  3. Compare Jantri value with your deal price, and take whichever is higher.
  4. Stamp duty is 4.9% of that amount.
  5. Registration fee is 1% of that amount, or nil if the property is registered only in a woman’s name.

Examples with real numbers

When your price is more than Jantri value

For example, you are buying a flat in Surat for ₹55 lakh, and its Jantri value is ₹42 lakh. Your price is higher, so duty is charged on ₹55 lakh.

If the flat is registered only in a woman’s name, she pays just stamp duty of ₹2,69,500.

When your price is less than Jantri value

Now suppose you are buying a 120 sq m plot in Ahmedabad for ₹75 lakh. Jantri rate for the zone is ₹70,000 per sq m, so Jantri value is ₹84 lakh. This time Jantri value is higher, so duty is charged on ₹84 lakh, not on your price.

There is a second thing to keep in mind here. When the price is below Jantri value, the Sub-Registrar can send the deed to the Deputy Collector (Stamp Duty Valuation) to check the value, under section 32A of the Gujarat Stamp Act. And because Jantri value is more than 110% of the price, the seller may have to pay income tax as if the sale price were ₹84 lakh. Our guide on section 50C explains this in detail.

Women buyers save on registration fee

Gujarat does not charge the 1% registration fee when a property is registered only in the name of a woman. On a ₹50 lakh flat that is ₹50,000 saved. If a man is also named as a buyer, for example a husband and wife buying together, the full fee has to be paid.

Stamp duty stays the same at 4.9%. Some websites say women pay 3.9% stamp duty in Gujarat, but we have not seen a government order for this, so plan your budget on 4.9%.

Maharashtra is different: there, a woman buying a home on her own pays 1% less stamp duty, under a government order from 2021.

What changed in 2025

Gujarat made some changes to its stamp law from 10 April 2025. Most buyers won’t notice a difference, but it helps to know:

Will the new Jantri increase my stamp duty?

Only if the new Jantri value of your property turns out to be higher than your deal price. A new Jantri was put out as a draft in November 2024, but it has not come into effect yet. You can follow the latest update on our page about the new Jantri rate in Gujarat.

Other costs to plan for

Stamp duty and registration fee are not the only costs when you buy a property. Keep some money aside for these too:

Gujarat stamp duty: common questions

Is stamp duty in Gujarat the same for flats, plots and shops?

Yes, the rates are the same: 4.9% stamp duty and 1% registration fee. What changes is Jantri rate used to calculate the value, because flats, plots and shops have different Jantri rates.

Is there a maximum registration fee in Gujarat?

We have not found any upper limit on registration fee for a sale deed in Gujarat, so plan for the full 1%. In Maharashtra, by comparison, it stops at ₹30,000.

Do women pay less stamp duty in Gujarat?

No, women pay the same 4.9% stamp duty. The saving is on registration fee, which is not charged when the property is registered only in a woman's name. Some websites mention 3.9% stamp duty for women, but we have not found a government order for it.

What if I paid less stamp duty than I should have?

You have to pay the balance duty along with a penalty. Since April 2025, the penalty is 2% of the balance for every month if you come forward yourself, up to 4 times the balance. If the department finds it, it is 3% a month, up to 6 times.

Who pays stamp duty in Gujarat, the buyer or the seller?

In most deals the buyer pays both stamp duty and registration fee. The buyer and seller can agree to split it differently, but it is best to write this down in the agreement.
